Non-EV batteries from China went to 25 percent
The 2024 Section 301 four-year review scheduled the step for lithium-ion batteries outside EVs. It took effect on January 1, 2026 under heading 9903.91.06, replacing the 7.5 percent List 4A rate that most catalogs were costed on.

EV lithium-ion batteries and battery parts from China rose from 7.5 to 25 percent on September 27, 2024. Pack assemblers buying cells and parts separately felt the change a year before importers of finished packs.

A 2026 layer replaced the reciprocal tariffs
After the Supreme Court ended the IEEPA tariffs in February and the Section 122 surcharge lapsed, a new layer under headings 9903.05.20 to 9903.05.84 took effect on July 24, 2026: 12.5 percent for China, Vietnam and Thailand, 10 percent for Malaysia and Indonesia, top-ups for Korea, Japan, Taiwan and the EU.
How to find the HS code for a battery product
Ask three questions in order. Can it be recharged? If not, it is a primary cell in 8506 and chemistry picks the subheading, 8506.50 for lithium. If it can, it is an accumulator in 8507 and chemistry again picks the subheading, 8507.60 for lithium-ion. Then ask what the battery powers: an electric vehicle sends it to .0010, a fully encased storage cabinet to .0030, and everything else to .0090. Finally, ask how it ships. A battery inside a drill, a scooter or a phone, or packed in the same retail box, normally follows the device. A spare battery in its own carton is classified as a battery and pays the battery rate. The shipping codes are not the tariff code
Carriers will ask for a second set of numbers on a lithium shipment, and buyers mix them up. UN3480 covers lithium-ion batteries shipped on their own, UN3481 covers lithium-ion batteries packed with or contained in equipment, and UN3090 and UN3091 do the same for lithium metal. Each cell and battery type needs a UN 38.3 test summary, and US ground and air shipments follow the packaging rules in 49 CFR 173.185. None of that changes the HTS code or the duty. The tariff code tells CBP what you owe; the UN number tells the carrier how to move it safely. Where battery classifications go wrong
The expensive mistakes repeat. A power bank filed as a charger under 8504.40 at Free, when it stores energy and belongs in 8507.60. A lithium-ion pack filed as nickel-metal hydride because the supplier reused an old invoice template. An e-bike battery filed under bicycle parts in 8714, which carries a different rate and a different Section 301 list. A storage cabinet filed under .0090 when it is fully encased and reports under .0030. Each one is a line CBP can correct after liquidation, with interest and, where it looks careless, a penalty. Under 19 USC 1484 the importer of record carries that duty of reasonable care, whoever filled in the code.
What it costs to classify a battery catalog
The January step-up means a catalog costed at 7.5 percent is now wrong on every China-made pack, and the 2026 layer moved every other origin too. Broker bands below are the documented per-product review rates in the US market; TariffWise figures are the published plans.
